Probate Intake Form

The following documents will be needed:

-Funeral documents showing that the funeral home was paid in full, but only if date of death was less than 2 years ago.

-Original Short Form Death Certificate- 2 originals if there is real property.

-Original Will- If any beneficiaries named in Will died before the decedent, a certified copy of that beneficiary's Death Certificate.

PART I. NAME OF DECEDENT (Person who died). What is the name of the decedent as shown on the Death Certificate? * This field is required.
What is the decedent's date of death? * This field is required.
What is the home address for the decedent? * This field is required.
Is the homestead the same as the address on the Death Certificate?
What is the County of Residence?
Is the decedent a U.S. Citizen?
Is there a Surviving Spouse? If yes, please provide surviving spouse name.
If yes, is there as Pre/Post Nuptial Agreement?
Was Decedent receiving Medicaid or public assistance of any sort?
PART 2. PERSONAL REPRESENTATIVE (PR) OR PETITIONER ---Is there a Personal Representative or Petitioner?
Provide the Name of the PR or Petitioner.
Provide the PR or Petitioner Address.
Provide the PR or Petitioner Telephone.
Provide the PR or Petitioner Email.
What is the Relationship to Decedent?
What is the Interest in the estate?
Does the PR or Petitioner have any felonies?
PART 3. BENEFICIARIES (Generally are spouse and children if there is no will). Does decedent have Beneficiaries?
For each beneficiaries, list the name, relationship to the decedent, the address and date of birth, if they are a minor.
PART 4. WILL --- Did the Decedent have a will?
If yes, what is the Date:
Is the will Self-Proving? (Self-proving is an affidavit by the will maker that affirms that the will was executed voluntarily and in the presence of 2 witnesses).
Is there a Separate Writing?
Is there a Codicil? (A codicil is a supplementary document that provides instructions or modifications to an already-existing will).
If the will is not self-proved, give the name and address of the witnesses:
Did the Decedent have a Trust?
Are the Beneficiaries the same?
Part 5. ESTATE ASSETS--- Are there estate assets? If yes, please describe what the assets are and whether the assets are jointly owned or have beneficiary designations.
Is there homestead?
Is there other real property. If so, Address and County
Are there any Household Goods? (valued greater than $20K)
Are there any Vehicles, Boats, etc.
Is there Cash/Checking Account?
Is there Savings Accounts?
Is there CD's?
Is there a Money market?
Is there Stocks & Bonds?
Is there Traditional IRA or ROTH IRA?
Is there 401(k)?
For each bank/investment/retirement account, please state approximate amount in each type of account on the date of death?
Is there Life Insurance?
Is there Future Inheritance?
Is there Annuities?
Is there Refunds or Deposit Returns expected?
Is there Digital Assets (PayPal, VenMo, BitCoin, etc.)
Are there other Assets? If yes, please list them.
Do you anticipate Decedent receiving any rebates of insurance premiums, deposits, or something similar? (If yes , what and approximate amount?
Is there a Trust in which Decedent had any interest?
Did Decedent own or have a interest in a business?
Part 6. SAFETY DEPOSIT BOX--- Did the decedent have a safety deposit box?
Part 7. KNOWN CLAIMS AND CREDITORS --- Did the decedent owe any creditor or have any claims? (e.g. credit cards, rent, hospital bills, business expenses, etc). List creditors or claims and amount owed.
Provide the name, address, Type of Debt (credit card, etc.) and Balance Owed:
